ജാതികളെക്കുറിച്ച് പ്രത്യേകിച്ചും ഭരണഘടനയിൽ നിർദ്ദേശിച്ച പ്രകാരം ഒരു
സമഗ്ര സാമ്പത്തിക, വിദ്യാഭ്യാസ, സാമൂഹ്യ സർവേ ഇതുവരെ
നടത്തിയിട്ടില്ലാത്തതിനാൽ ഓ.പി.ശുക്ലയുടെ കേസ് തള്ളിപ്പോകും എന്നദ്ദേഹം
അറിയിച്ചു. 1964 ലെ ലോക്കൂർ കമ്മീഷൻ റിപ്പോർട്ട് ശാസ്ത്രീയമായ ഒരു
പഠനത്തിന്റെ അഭാവത്തിലായിരിക്കണം ഇതുവരെ നടപ്പിലാക്കാൻ സാധിക്കാതിരുന്നത്.
എന്നിരുന്നാലും ദേശീയമായി പട്ടികജാതി/പട്ടികവർഗ്ഗങ്ങൾക്കായി ഒരു സമഗ്ര
സാമ്പത്തിക, വിദ്യാഭ്യാസ, സാമൂഹ്യ സർവേ നടത്തുവാൻ ഒരുപക്ഷെ
ഉത്തരവുണ്ടായേക്കും. അതിൻ പ്രകാരം പട്ടികജാതിയിൽ ക്രീമിലയർ നിബന്ധന
വരുവാനും അദ്ദേഹം സാദ്ധ്യത കാണുന്നു. അതുകൊണ്ടുതന്നെ ഈ കേസിൽ വൈകിയ
വേളയിലാണെങ്കിൽ പോലും കക്ഷി ചേരുവാൻ KVMS എടുത്ത തീരുമാനം അത്യന്തം
ശ്ലാഖനീയമാണെന്നും ഈ വിഷയത്തിൽ ഇനി എടുക്കുന്ന ഏതു തീരുമാനവും കേരള വേലാൻ
മഹാസഭയുമായി ആലോചിച്ചതിനു ശേഷം മാത്രമെ ഉണ്ടാകുകയുള്ളൂ എന്നദ്ദേഹം പറഞ്ഞു.

Humble Petition on behalf
of
the Petitioner above named.
MOST
RESPECTFULLY SHOWETH:
1.
That the applicant
–Intervener is an organization registered under Travancore Cochin Literary
Scientific and Charitable Societies Registration Act.1955 with Headquarters at
Cherthala, Allappuzha (district), Kerala State. The Society has been set up
with the objective of achieving progress, development, welfare and upliftment
of scheduled castes in Kerala, especially of Velan, Mannan, Perumannan and
Vannan castes. It aims to promote among its members the ability to maximize
their own capabilities, including participation in cultural, moral, economic,
education, training, employment and social activities. From making
representations to the Governments to holding dharnas, mochas or agitations, the
organization has always been in the forefront in protecting the interests of
members of these castes whenever there has been an infringement of their rights
or a curtailment of the benefits they are entitled to. Since its formation in
the year 1975, the organsiation has grown as the largest organisation of
combined Velan, Mannan, Perumannan, Pathiyan, Paravan and Vannan communities
with 27,000 registered members. It has 9 taluk committees at Cherthala,
Ambalappuzha, Vaikom, Kottayam, Meenachil, Kanjirapalli, Idukki, Kunnathunadu
and Perumbavoor and more than 200 branches in the state. The Petitioner O.P.
Shukla has filed the present writ petition before this Hon’ble Court praying, inter alia, for issuance of a writ of
mandamus or any other writ order or direction to the Respondent states to take
firm steps to implement the recommendation of Lokur Committee. The reliefs claimed
are an attempt by the Writ Petitioner to take away the benefit of the
reservation policy to the members of scheduled castes and scheduled tribes,
knowing fully that the reservations policy to these castes have time and again
been upheld by this Hon’ble Court on several occasions. The adjudication of the present writ petition
will have a direct bearing on the rights of the members of the applicant
society. Any directions to be issued or decision thereon by this Hon’ble Court
will severely affect the members of these castes in the State of Kerala as a
whole. Therefore it is utmost necessary that the applicant herein is permitted
to implead/intervene in the present writ petition.

That this Hon’ble Court has
repeatedly reminded us that the main object of providing reservation for
schedules castes and schedules tribes in civil posts and services of the
Government is not just to provide jobs to increase their representations in the
service but to uplift these people socially, economically and educationally to
help them achieve a higher rank in the society. The writ petitioner has in the
present writ petition sought for an implementation of the recommendations of
the Lokur Committee which in its report has identified certain castes in
various States as relatively advanced communities and therefore recommended
de-scheduling of these castes. That it is pertinent to mention that the
communities now sought to be deleted or excluded from the lists of Scheduled
castes in the State of Kerala - namely
Vannan, Mannan, Perumannan and Velan - were at one point of time
considered as untouchables and were discarded by the upper castes. Identified originally
as dhobi workers, the women folks does dhobi work for Avarnna (lower castes)
communities while men folk does menial jobs like climbing coconut trees,
cleaning and ironing cloths, white washing, traditional balachikilsa etc. That some of the social activists and leaders
took realized the need to eradicate this atrocious disparity pervading the
society, especially untouchability. They raised their voices against such
social evils, followed by deliberations and debates for the upliftment of these
communities and rooting out the untouchability and discrimination on the basis
of their castes. Thus were formed the Akhila Thiruvithamcore Velavar Mahasabha
in the year 1934 which later on merged with the Keraleeya Velan Masabha to form
the ‘Sanmargaposhini samastha Kerala Velan Mahasabha’ in the year 1936. This
Sanmargaposhini samastha Kerala Velan Mahasabha was later in 1944 renamed as
“Samastha Kerala Perumannan Velan Maha Sabha” to facilitate its service to all
communities (Velan, Mannan, Perumannan, Pathiyan, Paravan and Vannan). After re-organisation of States in 1956, the
above organization was further renamed as “Kerala Perumannar Velavar Maha
sabha”. Later it merged with Kerala Velan Maha Sabha (KVMS) in the year
1976. It may not be out of place to mention that the
above said Velan, Mannan, Perumannan and Vannan castes are same communities,
belong to one family and are spread all over Kerala but their concentration is
in different pockets where they are known by different names. For example, in
Central Kerala viz. Kottayam, Idikki, Pathanamthitta & Allappuzha districts
these one-time untouchable people were called as Velan by the Hindu upper castes while they were called as Mannan by their Christian masters.
They are known as Vannan in
southern districts of Kerala (Thiruvananthapuram, Kollam) while in northern
districts (Kasargod, Wynad, Kozhikode) they are called by the name Peruvmannan.

At the time of Indian
independence, the need was felt to bring these castes to the level of the upper
castes and at par with them through the process of reservation for the members
of these communities in Government services and local bodies of the Government.
The framers of the Constitution under the chairmanship of Dr. B. R. Ambedkar
and with the agreement of the people at large paved way for creation of a list
of those oppressed and downtrodden members in the society to be known as
Scheduled Castes and scheduled tribes with the assurance and promise to
honestly provide them their due rights in the society, reservations in
services, role in making of the Government or its local bodies and also
providing them with facilities in education so as to enable them to be at par
with the upper castes in the society.

However these provisions
enshrined in the Constitution remains as ‘provisions’ only without proper
implementation with the result that not much has changed in the lives of these
scheduled castes of Kerala, even after the country has celebrated 65 years of
independence from the British rule. They continue to be hated more and more and
their conditions are more deplorable than any other community in the State or
the country. Even today the members of these castes are forced to take up the
traditional and hereditary jobs of dhobi workers or climbing coconut trees or
painting houses. The benefits of reservation policies have failed to reach them
on account of their faulty implementation or non-implementation. There has not
been any socio- economic development of these castes as is clear from the
statistics on social, educational and economic conditions of scheduled castes-
velan, mannan, perumannan and vannan communities of Kerala. As per 2001 census, their combined population is
only 2,68,000 which is less than 1 % (0.8) of the total population of Kerala.
However more than 70% of them are still unemployed. It is also a matter of
concern that even in the arena of public representation, their role is basically
nil. The applicant seeks to rely on the following table in support of the
preceding facts.

That it is pertinent to
mention that the issue as to whether there is a need to exclude these
communities from the schedule lists can be looked into only after a detailed
analysis of their existing social and economic
development as on today. It is unfortunate and disturbing that the social and
economic statuses of these communities in the state of Kerala have not changed
in the last several decades and continues to be as dismal as before. While it
is a matter of record that most of them continue to live below the poverty
line, the maximum of these castes still continue to reside in the rural areas
and the villages, mostly making a livelihood working as landless labourers. Also
the fate of primary education in rural areas has collapsed due to inadequate
number of teachers. The very few who can afford send their children to private
schools, the others are victims of the poor and outdated educational system run
by the Government with the result that they continue to remain backward in the
field of education too. Thus it is crystal clear that there has not been any
social, educational or economic development of the velan, mannan, perumannan or
vannan castes in the State of Kerala over the last several decades and their
advancement is far away from reality. They still continue to be backward and
therefore deserve special protection rather than exclusion from the list of
Scheduled castes.

That without prejudice to
the submissions made in the preceding paragraphs, the applicant further submits
that the writ petition deserves to be dismissed as devoid of merits. The writ
petition is filed praying inter alia —
(1). To declare the powers, scope and ambit of articles 341 and 342
of the constitution so
as to make an equitable distribution of reservation among the depressed
classes;
(2). To issue an order directing the respondents to take firm steps to implement the recommendations of the Lokur committee and to exclude ‘CHAMAR, MAHAR, MALA, MEENA, DUSAD, PASSI and DHOBI etc from the scheduled list;
(3). To issue an order directing the respondents to take firm steps for the equitable distribution of share of reservation among 99% Ati dalit castes so as to ameliorate the suffering of age old Ati Dalits among the SCs/STs.
(4). To issue any other writ, order or direction as the hon. Court may deem fit, Just and proper in the facts and circumstances of the present case to give complete relief to the petitioner.
In respect of the contentions raised for allowing first prayer it is submitted as follows —
Under article 341(1) The President by notification has specified the castes, races or tribes to be deemed to be scheduled castes in the constitution (Scheduled castes) order, 1950. Similarly under Article 342 (1) The President by notification has specified the castes, races or tribes to be deemed to be scheduled tribes in the Constitution (Scheduled Tribes) Order, 1950. These two orders were subsequently modified by the President in scheduled casts and scheduled tribes list (Modification) Order, 1956. The communities so specified in the schedule attached to that Presidential Order of 1956 are scheduled caste and scheduled tribes. They are eligible for statutory reservation for the purpose of Election and Services as ensured by the provisions of the Constitution.
7. Under Article 341(2) and 342(2) the further inclusion or exclusion of any castes, races or tribes in the said lists is to be made by the Parliament. Neither the state government nor any court or any other authority has jurisdiction to make any modification of these lists. It is the prerogative of the Parliament to include in or exclude any caste, race or community from the said lists. The Parliament has later modified the said lists by invoking this power and passed the scheduled castes and scheduled tribes Orders (Amendments) Act, 1976 (Act 108 of 1976), The Constitution (Scheduled Castes) Orders (Second Amendment) Act, 2002 and the scheduled castes and scheduled tribes Orders (Amendment) Act, 2002 (Act 10 of 2003). The list so modified is now in force. The Central Government has fixed certain norms and procedures for making such modifications. The cabinet subcommittee on scheduled castes, scheduled tribes and Minorities has approved the modalities as early as on 15.06.1999 and later revised the same on 25.06.2002. A format for sending proposals for making amendment to the list by the state government is also prescribed as early in 1999. The petitioner has not cared to disclose or reveal the said existing practice adopted by the government in the matter of making modification to the lists. It is pertinent to mention that following this procedure many modifications have since been made to the list from time to time. The statement made at para 25 of the W.P that various castes/races or groups/tribes have been included in the schedule without making any imperial study and that too for political consideration and not a single community / castes / tribes have been excluded from the list, is not true to facts. In drawing of the list and making modification, the test applied is “extreme social, educational and economic backwardness arising out of the traditional practice of untouchabilty’. So many castes and tribes were since excluded and also included in the list based on the said criteria. But no exclusion is made based on the concept of advanced group as contended by the petitioner. The concept of exclusion of Creamy layer is applicable only in the case OBCs. It is against the mandate of the Constitution to apply the said principle in the case of SCs and STs.

The petitioner has challenged the power of the President of India under Articles 341 & 342 of the Constitution and has raised untenable contentions that the power of the President is coupled with a duty to include or exclude the respective castes, Races, Tribes of the purpose of making available the beneficial provisions of the Constitutions and the power carries with it the duty to lay down the principles for the exercise of the powers and has contended that the further inclusion of the Castes, Races etc. without excluding the Socially advanced groups from the list amount to disregard of the interference of Articles 341 & 342 and the exercise of the power led to the frustration of the objectives of Articles 15(4), 16 (4), 46 and 335 of the Constitution. The petitioner has highlighted the resolution passed by the Andhra Pradesh Legislative Assembly, on the need to categorize the SCs reservation into A, B,C, D groups as recommended by Justice Ramachandra Raju Commission, and passed scheduled caste reservation (Rationalization) Act, 2000 (Act 20 of 2000). The Act was challenged by one E.V. Chinnaiah before the Hough Court of Andhra Pradesh. Even though the Hon. High Court upheld the validity of the Act, the Apex Court has set aside the Act on the ground that the apportionment of the reservation of SCs to subgroup within the caste cannot be done by the State legislature and only the Parliament is competent to do so. The Hon’ble Supreme Court categorically held that as per Articles 341 & 342 of the Constitutions, SCs & STs are one unit, they cannot be subdivided into subcategories for the purpose of reservation. So in view of the said provision of law the contentions raised in support of its first prayer is unsustainable. It is seen that the then Central Government has taken due follow up action on the said main recommendations and the Parliament has since passed Scheduled Castes and Scheduled Tribes Orders (Amendment) Act, 1976 (Central Act 108 of 1976). The said list has been again modified during the year 2002. The SCs/STs list proposed by the committee has since undergone so many changes.

It is most respectfully submitted that the Lokur Committee was appointed by the Central Government as early on 1.6.1965 i.e. at a time when no modalities for revision of SC/ST list were fixed by the Central Government, as an advisory committee on revision of SC/ST List. However, the said Committee has gone outside the terms of reference and made certain general recommendations (not specific recommendations). The fifth general recommendation so made by the committee at Para 50 of the report is no doubt a controversial one and the same is quoted below.
“As has been pointed out in an earlier Chapter, it is imperative that the more advanced communities in the lists are gradually descheduled. To accelerate the pace of descheduling, a dead-line may perhaps be fixed when the lists of Scheduled Castes and Scheduled Tribes are totally dispensed with. In our opinion, it is only by such a process that we can bring about complete integration of the population. In order to weed out the advanced castes and tribes from the lists in times to come it is necessary that an intensive survey be undertaken to ascertain the social, educational and economic progress made by each of the Scheduled Castes and Scheduled Tribes from time to time. The task will, no doubt, be stupendous and expensive but it is only through such periodic surveys that the results of the various development schemes can be correctly ascertained. We would suggest, in this connection, that the possibility of the Census and National Sample Survey authorities assisting in this task may be explored.” The said general recommendation has to be read with the observation made at para 16 of the report where in it is stated that time has come when the question of descheduling the relatively advanced Communities should receive serious and urgent consideration. It is further stated that several persons who appeared before the committee brought the names of certain communities mentioned in the said para in their opinion are relatively advanced and could forthwith be descheduled -the State of Kerala the communities namely Vannan, Mannan, Perumannan and Velan are hinted to be so advanced group.
10. It is respectfully submitted that the said communities are not at all advanced groups. Actually they were included in the SC list even from the date of original order. Those communities were included in the list after conducting detailed anthropological as well as etymological studies, so also as per the recommendations of the Franchise sub committee and also considering the evidences taken by the Lothian Committee.

Further the committee vide para 17 has very clearly admitted that they have not been able to make a closer investigation into the conditions of these communities in the short time at their disposal, they are unable to make a specific recommendation in regard to these communities. The said general recommendation made by the committee was outside the preview of the terms of references and also against the mandate of the Constitution. So naturally the then Central Government has rejected the said recommendation and no follow up action was seen taken in the matter. The recommendation has no relevance at this distance of time and the petitioner cannot be allowed to rely on the same. It may be true that as a result of reservation, a few individuals belonging to SC/ST Communities have secured jobs or attained social status. This does not mean that the entire community has become an advanced group liable to be descheduled. So there is no logic in the contentions raised in the writ petition and the propositions therein are made with a hidden intention to torpedo the reservation benefits enjoyed by the Scheduled Communities.
12. In
such circumstances the applicants herein pray that they be permitted to implead
themselves in the present Writ Petition and raise contentions assailing the prayers
sought for therein. It is further submitted that any orders passed by this
Hon’ble Court in the above Writ Petition filed will have a direct impact on the
interest of this applicants, and hence this Hon’ble Court may be pleased to
allow this application and the applicants be heard before any orders are passed
in the above application.
PRAYER
It
is therefore, necessary in the interest of Justice that this Hon’ble Court be
pleased to
(i)
pass an order permitting the
applicant to implead as Respondent in
Writ Petition (C) No. 337 of 2011 pending before this Hon’ble Court and to hear the applicant before any orders
are passed therein ;
(ii)
or in the alternative pass
an order permitting the applicants to
intervene in file documents and make submission before this Hon’ble Court at
the time of hearing;
(iii)
pass such other and further
reliefs as this Hon’ble Court may deem fit and proper in the facts and
circumstances of the case.
AND FOR THIS ACT OF KINDNESS THE
PETITIONER SHALL AS IN DUTY BOUND EVER
PRAY.

I would like
to bring to your kind notice of a shocking incident of denying 641 MBBS seats
to SC-ST s in Kerala State during the period 2005 to 2012.
The office of the Entrance Commissioner is responsible for denying genuine seats to SC/ST students. It is fraud committed by the office of the Entrance Commissioner and that of KIRTADS (Kerala Kerala Institute for Research, Training and Development Studies of Scheduled Castes and Tribes which is a government organisation supposed to be working towards the development of the Scheduled Castes and Tribes by engaging in research and undertaking studies to identify problems faced by these marginalised sections of the society and by suggesting recommendations for their uplift). The modus operandi is all eligible SC/ST sudents are subjected to be cleared by the KIRTADS by the office of the Entrance Commissioner. The KIRTADS in turn clear some candidates and majority of the students are subjected to thorough scrutiny. Such majority of SC/ST students are withheld pending inquiry. This inquiry shall not take place till the entrance procedures are completed. These reserved seats are not carry-forward as per the office of the Entrance Commissioner's published prospectus. During the period 2005 to 2012 alone there are s shocking number of 641 seats were lost to SC/ST students for ever and during this period there were 947 students under inquiry which is continuing still.

We strongly
belive that there is a nexus bet ween these two institutions viz.
office of the Entrance Commissioner and KIRTAS working out robbed off the SC/ST
medical seats and to sell it to the self financing institutions. It is a
deliberate attempt to bud the nip of the SC/STs attempt to cheap and benevolent
medical care.
We demand a
thorough inquiry in the matter and reinstate the SC/ST students who lost their
chance to medical profession or carry forward the lost seats in a phased
manner.

കൊണ്ടിരുന്ന വേലന് മഹാസഭ (VMS) ലയിച്ച് ഒന്നാകുന്നതിനുവേണ്ടി 2012 ജൂലൈ
മാസം 8 ഞായറാഴ്ച്ച കുറുപ്പംകുളങ്ങര ശ്രീ. കുമാരന്റെ വസതിയില് വച്ചു കൂടിയ
കുടുംബ സമ്മേളനത്തില് തീരുമാനിച്ച് ലയന പ്രഖ്യാപനം നടത്തി. KVMSന്റെ
സ്ഥാപകരില് പ്രധാനിയായ ശ്രീ. M.P. വാസുദേവന് അവര്കളുടെ അധ്യക്ഷതയില്
കൂടിയ സമ്മേളനം KVMS പ്രസിഡന്റ് ഡാ. N. V. ശശിധരന് അവര്കള് ഉത്ഘാടനം ചെയ്തു. കൊടുത്തിരിക്കുന്ന ഈ നീയമം ഏപ്രില് 27 -)0 തീയതി കൂടിയ സര്വകലാശാല
ധനസഹായ കമ്മീഷന് (UGC) ന്റെ 484 മത് മീറ്റിങ്ങിലാണ് അംഗീകരിച്ചത് .
തുടര്ന്ന് കേന്ദ്ര ഗവര്ന്മെന്റ് മനുഷ്യശേഷി വികസന വിഭാഗവും
അംഗീകരിച്ചു. ഇതിന് പ്രകാരം പട്ടിക ജാതി / പട്ടിക വര്ഗ വിദ്യാര്ത്ഥീകള്ക്ക് പക്ഷപാതപരമായി അര്ഹതപ്പെട്ട
മാര്ക്ക് നിഷേധിക്കുന്ന അദ്യാപകര് , ക്ലാസ്സ്മുറിയിലും ഹോസ്റ്റ്ലിലും
